us live from outside of the courthouse in san francisco to explain what was at stake. good afternoon, brian. >> reporter: hey, good afternoon, tori. well, what was at stake today was a civil case. but there was no decision made today here inside san francisco federal court. on the case of johannes mehserle and other officers involved in the shooting of oscar grant during a new year's party a few years ago. now, attorneys for anthony p. eroni and johannes mehserle argued they should be offered immunity because they argued the shooting was an accident. they also say it was tragic but there was reasonable actions by the officers to act the way they did. meanwhile, the attorneys for the victims and four others claim it was not an accident, that they were defenseless and should not be granted qualified immunity of the law. here's what both sides had to say. >> what it means is the simple fact that our rights have been violated. those young men are tie to us as a family -- are tied to us as a family. this an opportunity for the world to see that we do have legal civil rights in this so- ca

"mornings on 2" starts now. >>> good morning, everybody. welcome to "mornings on 2." i'm brian flores. dave clark has the morning off. >> good morning. i'm pack cook. tori campbell is off today. it's -- i'm pam cook. it it tori campbell is off today. >>> a christmas morning fire in the south bay. it started a few hours ago. janine de la vega is on the scene and joins us from campbell. how does it look out there, janine? >> reporter: well, the fire is out here at this commercial building on del avenue. firefighters are still putting water on it. you can actually see the smoke still rising in the air coming from that building. now, originally we were told that the firefighters had not entered the building yet for safety precautions. let's go to some video. here you can see some flames shooting from the roof. we were told they were 50 feet up in the air at one point. firefighters were called to the scene just before 5:00 a.m. they immediately started to attack it from the outside. the

to the desk. >>> san francisco international airport is gearing up for what could be the busiest day holiday travel day of the season. allie rasmus is live there at the airport with information on how many passengers could pass the airport today. >> reporter: it's supposed to be one of the busiest travel days of the year for san francisco international airport with 130,000 passengers making their way in and out of the terminals here in a single day. even at 4:30 in the morning you can see there is more foot traffic. there is more activity than we expect to see here on a friday morning. you can see a number of cars and passengers unloading their stuff out of the taxis. making their way into terminal two. inside we just checked the board, we're happy to report there are no delays or canceled flights out of sfo. in fact, we saw one flight was leaving ten minutes early. that was heading to washington. that could all change as the day goes on because of the weather. rain is supposed to move in through the bay area later this morning. that usually creates delays at sfo. again it's not raining. the

"mornings on 2" starts right now. >>> good morning, everybody. welcome to "mornings on 2." i'm brian flores. dave clark is off today. >> yes, he is. >> good morning. i'm pam cook. tori campbell is also off. it's monday, december 24th. >>> we're following developing news out of marin county this morning where search-and-rescue teams are about to search for a missing man. alex savidge has more on how a traffic stop turned into a much larger situation. alex? >> reporter: well, now that the sun is coming up, the team is going to resume searching for this team, somewhere in the cordova creek. the man is suspected of drunk driving and ran from officers during a traffic stop. it happened earlier in the morning. he jumped into the creek in an area where the water is moving very quickly. authorities put a boat in the water right away to search the bas ofthe creek but there was no sign of the man. this all began after midnight when ross police made a dui stop on the man's car near sir francis drake and c
've had light conditvery happ to see that getting into san francisco. the wet weather has not reached the toll plaza but it certainly has reached parts of the north bay. rosemary will be here in a moment to elaborate on that. 237, westbound, looks like some sun there and traffic light. when you see this light traffic, you know we're having a lighter than usual day. in the south bay, we don't have a lot of slow traffic, just some traffic approaching the mckee road turnoff. let's go to rosemary. >>> good morning. gearing up for a wet holiday weekend ahead. ten minutes until the official sunrise. a mix of clouds out there and a few peaks of sunshine. we're looking at rain continuing to shot. all the way down into san francisco. this eventually will hit the ground and it should happen toon. the north bay has been hammered at times. along highway 101, redwood boulevard, san marin drive, light to moderate rain falling in nova doe, lucas valley, san rafael, seeing light to moderate rain. it was coming down pretty good a few minutes ago. light rain all the way down into daly city and it looks

, the san francisco board of supervisors will cast their final vote on the public nudity ban. brian flores joins us live from san francisco. there's still strong emotions on this. >> reporter: hi, tori. yes, still strong emotions. despite a large group of nudists at city hall -- >> shame on you! shame on you! >> reporter: -- the public nudity ban barely passed during its first vote in late november. but for allen he didn't want it passed at all. >> you have the action of a small group of people is what's going on. >> reporter: public nudity is at the forefront once again. it passed first time in a 6-5 vote. >> i don't think the ban is necessary. i think san francisco is a really open place. i don't have a problem with public nudity. i think people can clues or not to -- can choose or not to. >> if i had children, i wouldn't want them having to look at that. it's not -- it makes me angry. >> reporter: if passed, the ordinance would effectively put a ban on nudity in most places. the exceptions to the ban would be during permitted parades, fairs and festivals. at first this woman was for pub
